Owning houses and apartments in Thailand

As a non-Thai citizen, foreigners cannot own land in Thailand. Also when it comes to apartments, the ownership opportunities are somewhat restricted. For instance, in an apartment complex (so-called condominium) only 49% of the total living area can be owned by non-Thai citizens. For many years, and in spite of these limitations, non-Thai citizens have chosen to invest in homes in Thailand.
Today, most houses are being acquired with leasehold rights, so-called land lease. A land lease means the buyer signs a lease contract with the owner of the land, through which the landowner grants leasehold rights for 30 years to the person who is to build and utilize the house. Normally, extensions for two additional 30-year periods are promised at a predetermined price that is often paid at the time of signing the contract. The problem with this way of buying a home is that the extensions of the contract are not enforceable by a court in the case that the owner has passed away or gone bankrupt. Similarly, according to Thai law, it is not possible to pay in advance for the additional extensions of the contract. Yet another limitation is that the leasehold right will not be passed on to the heirs of the deceased.
In order to avoid the above-described limitations of the lease contract, Black Mountain has developed a “Club” model, in close co-operation with Thai lawyers. This model guarantees that you, as a member, has an entirely unlimited opportunity to utilize your home investment, without any restrictions in time.
