Villa B

Villa B Slightly smaller than Villa A, however, just as luxurious, Villa B’s main difference is the living quarters are based on the upper lever with the infinity swimming pool offering the magnificent golf course views while you cool off or relax with a sundowner cocktail with friends.

Conditions of ownership

Owning houses and apartments in Thailand at Black Mountain Golf Club.

As a non-Thai citizen, foreigners cannot own land in Thailand. Also when it comes to apartments, the ownership opportunities are somewhat restricted. For instance, in an apartment complex (so-called condominium) only 49% of the total living area can be owned by non-Thai citizens. For many years, and in spite of these limitations, non-Thai citizens have chosen to invest in homes in Thailand.

Today, most houses are being acquired with leasehold rights, so-called land lease. A land lease means the buyer signs a lease contract with the owner of the land, through which the landowner grants leasehold rights for 30 years to the person who is to build and utilize the house. Normally, extensions for two additional 30-year periods are promised at a predetermined price that is often paid at the time of signing the contract. The problem with this way of buying a home is that the extensions of the contract are not enforceable by a court in the case that the owner has passed away or gone bankrupt. Similarly, according to Thai law, it is not possible to pay in advance for the additional extensions of the contract. Yet another limitation is that the leasehold right will not be passed on to the heirs of the deceased.

In order to avoid the above-described limitations of the lease contract, Black Mountain has developed a “Club” model, in close co-operation with Thai lawyers. This model guarantees that you, as a member, has an entirely unlimited opportunity to utilize your home investment, without any restrictions in time.


From a legal point of view, this model means that you as a member of Black Mountain:

  1. Are a shareholder in the company which will control the area where your home is located.
  2. Have an agreement with the company that owns the land, implying a completely unlimited right of possession to the land and the house/apartment. This right of possession is regulated by the laws of Thailand and has no time limitations whatsoever.
  3. Have a lease contract for a 30-year period that will be registered with the Department of Lands. Since the limitations in the lease contract are eliminated through the right of possession agreement, this lease contract gives an additional level of security through its registration with the Department of Lands with boundary coordinates for the house officially registered.

For you as a Black Mountain member, this model means that:

  1. The value of your investment will increase as the right of possession to the house and land plot or the apartment comes without any time limitations. With a lease contract only, the value possibly declines towards the end of the first 30-year period due to the uncertainty on the conditions for an extension.
  2. Your home investment will be possible to control through a will or through the existing rules of inheritance.
  3. It will be possible for you to transfer or resell your investment on your own terms.
